Welcome to The Arcane Archives. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before subscribing or using any features.

1. Acceptance of Terms

By creating an account, subscribing to our services, or accessing any content on The Arcane Archives, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our platform.

2. Monthly Subscription Service

• Subscription Fee: Access to premium content, educational modules, trading insights, live calls, and all platform features requires an active monthly subscription of £128/month.
• Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method automatically on a recurring monthly basis until you cancel.
• Billing Cycle: Your subscription renews automatically each month on the anniversary of your initial subscription date. You will be charged the then-current subscription fee unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting us via Telegram @Arcaneadvice2028. Cancellation takes effect at the end of your current billing period, and you will retain access until that date.
• No Refunds: All subscription payments are final and non-refundable. You will retain access to all features until the end of your paid billing period, but no partial refunds will be issued for unused time.
• Price Changes: We reserve the right to modify subscription pricing. You will be notified of any price changes at least 30 days in advance, and changes will take effect on your next billing cycle.

3. Account Registration & Security

• Age Requirement: You must be at least 18 years old to use The Arcane Archives.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
• One Account Per Person: Each subscription is for individual use only. Account sharing is strictly prohibited.

4. Educational Content & Risk Disclaimers

• Trading & Investment Risks: All trading signals, market analysis, stock picks, and investment-related content are provided solely for educational purposes. Trading and investing involve substantial risk of loss, and you could lose all of your invested capital.
• No Guarantees: We make absolutely no guarantees, representations, or warranties regarding earnings, profits, results, or performance. Past performance does not indicate or guarantee future results.
• Your Responsibility: You acknowledge and agree that you are solely responsible for your own trading and investment decisions. You should conduct your own research and consult with licensed financial professionals before making any financial decisions.
• Risk Acknowledgment: By using this platform, you acknowledge that you understand the risks involved in trading and investing and that you could lose some or all of your money.
• Broker Relationships: The Arcane Archives may receive compensation as an Introducing Broker from IC Markets and other brokers. This does not influence our educational content, but you should be aware of this relationship.

5. Permitted Use & User Conduct

You agree to use The Arcane Archives responsibly, lawfully, and in accordance with these terms. The following actions are strictly prohibited:

• Sharing, distributing, or transferring your login credentials or account access to any other person
• Recording, copying, distributing, reselling, or reproducing any course content, videos, or educational materials without explicit written permission
• Harassing, threatening, bullying, or abusing other members or staff
• Posting spam, promotional content, or solicitations in community areas
• Attempting to gain unauthorized access to our systems, servers, or databases
• Using bots, scrapers, automated tools, or any technology to access or extract content from the platform
• Engaging in any activity that disrupts or interferes with the platform's operation
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
• Using the platform for any illegal purpose or in violation of any local, state, national, or international law

Violation of these conduct rules may result in immediate account termination without refund.

6. Intellectual Property Rights

All content on The Arcane Archives, including but not limited to:

• Educational courses, modules, and video content
• Trading signals, analysis, and insights
• Text, graphics, logos, images, and software
• Platform design, layout, and user interface
• Proprietary methods, systems, and frameworks

...is the exclusive property of The Arcane Archives or its licensors and is protected by United Kingdom and international copyright, trademark, and intellectual property laws.

Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content strictly for your personal, non-commercial educational purposes only. This license does not permit you to:

• Reproduce, duplicate, copy, or redistribute any content
• Create derivative works or modify any content
• Use content for commercial purposes or monetary gain
• Remove or alter any copyright, trademark, or proprietary notices

7. Community & Content Standards

When participating in community features (forums, live calls, chat), you agree to:

• Be respectful and professional in all interactions
• Not share personal trading positions or account sizes publicly
• Not provide specific trading advice to other members
• Not engage in pump-and-dump schemes or market manipulation discussions
• Respect the privacy and confidentiality of other members

8. Account Suspension & Termination

We reserve the right to suspend, restrict, or permanently terminate your account and access to The Arcane Archives at our sole discretion, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent activity, chargebacks, or payment disputes
• Sharing account credentials or unauthorized account access
• Abusive, harassing, or threatening behavior toward members or staff
• Unauthorized distribution or reproduction of copyrighted content
• Use of bots, scrapers, or automated access tools
• Any activity that damages or threatens the platform's integrity
• Legal or regulatory compliance requirements

Effect of Termination: Upon termination, you will immediately lose access to all content, features, and services. Your account data may be permanently deleted. No refunds will be provided for terminations due to Terms violations.

9. Disclaimers & Limitation of Liability

To the maximum extent permitted by law, The Arcane Archives, its owners, operators, employees, contractors, and affiliates shall not be liable for any:

• Trading or Investment Losses: Direct, indirect, incidental, consequential, or punitive damages arising from your trading or investment decisions based on platform content
• Financial Losses: Any financial losses, lost profits, lost revenue, or economic damages of any kind
• Technical Issues: Service interruptions, downtime, errors, bugs, or data loss
• Unauthorized Access: Security breaches, unauthorized access to your account, or data theft
• Third-Party Actions: Actions or inactions of third-party service providers, brokers, or payment processors
• Content Accuracy: Errors, omissions, or inaccuracies in educational content or market analysis
• Consequential Damages: Any indirect, incidental, special, exemplary, or consequential damages

Maximum Liability: In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid for your subscription in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Arcane Archives, its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the platform
• Your violation of these Terms of Service
• Your violation of any rights of another person or entity
• Your trading or investment decisions and resulting financial outcomes
• Any content you submit or post to the platform

11. Third-Party Services & Links

The Arcane Archives may contain links to or integrate with third-party websites, services, or brokers, including but not limited to:

• IC Markets and other forex/trading brokers
• Payment processors (Stripe)
• Market data providers (TradingView)
• Social media platforms
• Other external resources

We are not responsible for and do not endorse the content, privacy practices, terms, or actions of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

12. Data Privacy & Security

Your use of The Arcane Archives is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our platform, you consent to our data practices as described in the Privacy Policy.

While we implement industry-standard security measures, we cannot guarantee absolute security. You acknowledge that you transmit data to us at your own risk.

13. Modifications to Terms

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. Material changes will be notified to users via:

• Email notification to your registered email address
• Prominent notice on the platform dashboard
• Update to the "Last Updated" date at the top of this document

Changes become effective immediately upon posting. Your continued use of the platform after changes are posted constitutes acceptance of the updated terms. If you do not agree to the new terms, you must stop using the platform and cancel your subscription.

14. Governing Law & Dispute Resolution

Governing Law: These Terms of Service are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from or relating to these terms or your use of The Arcane Archives shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Informal Resolution: Before initiating formal legal proceedings, you agree to first attempt to resolve any disputes informally by contacting us via Telegram @Arcaneadvice2028.

15. Severability & Waiver

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and The Arcane Archives regarding your use of the platform and supersede all prior agreements, understandings, and communications.
